By accessing or using the Kiyyex website or mobile application (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Service.
By completing the sign-up process and verifying your identity through a one-time password (OTP), a user account ("Account") will be created. Upon successful registration, we will confirm the creation of your Account via email.
By registering for an Account, you acknowledge and agree that these Terms are automatically accepted upon successful completion of the registration process. No separate agreement between the parties shall be executed at any time in relation to the acceptance of these Terms.
Account Holder means a power of gym operator, library operator and educational institute which has a user account (generally this will be your business or if you are a handler, the business which you are advising)
The Service means our Kiyyex software which is accessed and used via our password protected websites or application.
(WE, US, or OUR) refers to Kiyyex Infotech Private Limited and its affiliated company.
You means you, the person who accesses and uses this website or application and/or the Service.
To access the Service, you must create an account by submitting your details on our “Sign Up” page. Account creation requires OTP verification, after which these Terms are automatically accepted. No separate agreement between the parties shall be executed at any time. Accounts can only be created by authorized institutions/organizations or their admins.
As a company, Kiyyex does not ask fitness freak, student and parents for data directly. Any data in the software is shared by the gym, library, and schools/colleges with which Kiyyex signs a contract or is collected because the gym, library, and schools/colleges needs the fitness freak, student or parent to provide this data to the gym, library, and schools/colleges so they can do what is required to be done.
Kiyyex signs a contract with the gym, library, and schools/colleges that it works with. No data is taken from the institution until the contract is signed by both parties.
The personal information of fitness freak, student and parents is collected by the gym, library, and schools/colleges directly. Kiyyex does not send data requests directly to fitness freak, student and parents.
We share data templates for details required for various applications that the gym, library, and schools/colleges is using. The gym, library, and schools/colleges share the data with us directly. No third party is given the data during this process. In some cases gym, library, and schools/colleges ask us to provide applications to staff, fitness freak, students and parents from whom data is required to be collected as needed by the gym, library, and schools/colleges. This is strictly to be able to enable the gym, library, and schools/colleges to run their educational institution.
We use the information only for the various applications that the gym, library, and schools/colleges is using. We do not share data with any other party.
All data that gym, library, and schools/colleges share with us is kept secure and private. In order to maintain confidentiality and security of your personally identifiable information, Kiyyex undertakes the following:
We keep your personal information as long as we have an ongoing contract with the gym operator, library operator, educational institution that we are associated with. In case we end our contract with a gym, library, and schools/colleges, we share all current data with the educational institution, and delete this data from our servers.
We do not share your personal information with anyone, including third party vendors. In case we need to integrate the software with any third party app that is required for the software, then we take explicit permission from the gym, library, and schools/colleges to do so. Kiyyex is not in the business of selling your information to advertisers or other third parties.
‘Cookies’ are small text files that are stored by the web browser on your computer or mobile device. A cookie file is stored in your web browser and allows the Site or a third-party to recognize you and make your next visit easier and the Site more useful to you. Websites use these files to store information such as personalisation details or the contents of a shopping basket.
We use cookies on our websites for the Login. These are cookies that are set by the portal directly. These cookies are used to verify whether your login has been authenticated.
By subscribing to the Service and making a payment towards the subscription, the User acknowledges and agrees that all payments are non-refundable under any circumstances. The User may cancel their subscription at any time; however, such cancellation will not entitle the User to any refund, whether in full or in part, of any payments already made. No exceptions to this policy will be granted.
Cancellations can only be made through by pressing “Cancel” button provided along the booking history on Kiyyex Platform. No cancellation shall be accepted over email, phone call or communicated using any other mean.
Any dispute, controversy, or claim arising out of or in connection with this Program, including any question regarding its existence, validity, interpretation, or termination, shall be resolved through arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, or any statutory modification or re-enactment thereof for the time being in force. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of the parties and the venue of Arbitration will be Jaipur and the language of the proceedings shall be English.
Kiyyex reserves the right to update this Privacy Policy at any time. Any material changes will be communicated to Institutions prior to implementation.
